1. About Us

CustomBierViltjes.nl ("we", "our", or "us") produces custom-designed beer coasters based on artwork provided or approved by our customers.

These Terms apply to all offers, quotations, orders, sales, and deliveries unless agreed otherwise in writing.

2. Orders

All orders are subject to acceptance.

We reserve the right to refuse or cancel any order if:

• the artwork violates copyright or trademark laws;
• the artwork contains illegal or offensive material;
• incorrect pricing or technical errors occur;
• production is not possible.

An order becomes final once payment has been received and we have confirmed the order.

3. Custom Products

Every coaster order is produced specifically for the customer.

Because our products are custom-made, they cannot be resold to another customer. For this reason, orders cannot be cancelled once production has started.

4. Customer Artwork

4.1

The customer is responsible for all uploaded artwork, images, logos, text, and designs.

By uploading artwork, you confirm that:

• you own the rights or have permission to use it;
• it does not infringe any copyright, trademark, or other intellectual property rights;
• it does not contain illegal, defamatory, hateful, or offensive material.

If a third party makes a claim relating to your artwork, you agree to fully indemnify and hold CustomBierViltjes.nl harmless from any claims, damages, legal costs, or expenses.

We reserve the right to reject artwork at our sole discretion.

4.2

Custom Bier Viltjes is under no obligation to investigate or verify the ownership or validity of any intellectual property rights in artwork submitted by the Customer. We are entitled to rely on the Customer's representations and warranties. However, we reserve the right, at our sole discretion, to refuse, suspend, or cancel any order if we reasonably believe that the submitted artwork may infringe the intellectual property or other rights of a third party or otherwise violate applicable law.

5. Print Files

Customers are responsible for providing print-ready files.

Although we may identify obvious issues, we are not responsible for:

• spelling mistakes;
• grammar errors;
• incorrect dimensions;
• low-resolution images;
• poor image quality;
• missing fonts;
• incorrect colors supplied by the customer.

If you approve a proof, you accept full responsibility for the final printed result.

6. Color Variations

Printed colors may differ from what appears on phones, tablets, or computer monitors.

Small differences in:

• color,
• brightness,
• contrast,
• cutting,
• alignment,
• folding,
• positioning,

are normal in commercial printing and are not considered defects.

7. Digital Proofs

If a digital proof is provided, production will only begin after customer approval.

Once approved:

• no further changes can be made;
• the customer accepts responsibility for the approved design.

If no proof is requested, production will begin using the uploaded files.

8. Prices

All prices are shown in Euros (€).

Unless stated otherwise:

• prices include VAT where applicable;
• shipping costs are calculated separately during checkout.

We reserve the right to correct pricing errors before accepting an order.

9. Payment

Orders must be paid in full before production begins.

If payment is not received, we may delay or cancel production.

Ownership of all goods remains with CustomBierViltjes.nl until full payment has been received.

10. Production Times

Production times shown on our website are estimates.

Although we always aim to meet these estimates, delays may occur due to:

• supplier delays;
• equipment failures;
• holidays;
• shipping delays;
• force majeure;
• high order volumes.

Estimated production dates are not guaranteed.

11. Shipping

Risk of loss transfers to the customer once the order has been handed to the shipping carrier, except where mandatory consumer law provides otherwise.

We are not responsible for delays caused by:

• shipping companies;
• customs;
• weather;
• strikes;
• other events beyond our control.

Customers are responsible for providing the correct shipping address.

Orders returned due to an incorrect address may require additional shipping charges.

12. Inspection Upon Delivery

Customers should inspect their order as soon as possible after delivery.

Any problems must be reported within 14 days of delivery.

Claims submitted after this period may not be accepted.

13. Returns & Refunds

Because every product is custom-made, returns are generally not accepted.

Refunds will only be considered if:

• the wrong product was delivered;
• the product contains a manufacturing defect;
• the product differs substantially from the approved design.

Refunds will not be issued for:

• customer design errors;
• spelling mistakes;
• low-quality uploaded images;
• color differences within normal printing tolerances;
• change of mind.

Where appropriate, we may choose to replace the product instead of issuing a refund.

14. Production Tolerances

Due to the printing process, slight variations may occur.

This includes minor differences in:

• trimming;
• folding;
• alignment;
• color;
• finishing.

These variations are considered acceptable within normal commercial printing standards.

15. Intellectual Property

15.1

Customers retain ownership of their original artwork.

By placing an order, the customer grants CustomBierViltjes.nl a limited license to use the artwork solely for producing and delivering the ordered products.

We do not claim ownership of customer artwork.

Our website, branding, logos, product photos, text, and designs remain the property of CustomBierViltjes.nl.

15.2

The Customer warrants and represents that they are the lawful owner of, or have obtained all necessary rights, licenses, permissions, and authorizations to use, reproduce, print, and distribute all artwork, images, logos, text, designs, trademarks, and any other materials submitted to CustomBierViltjes.nl in connection with an order.

The Customer further warrants that the submitted materials do not infringe, misappropriate, or otherwise violate any copyright, trademark, patent, design right, trade secret, privacy right, publicity right, or any other intellectual property or proprietary rights of any third party.

The Customer shall fully indemnify, defend, and hold harmless CustomBierViltjes.nl, its owners, directors, employees, affiliates, and representatives against any and all claims, demands, legal proceedings, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to the Customer's submitted materials or any alleged infringement of third-party rights.

This warranty applies to all materials submitted by or on behalf of the Customer.

16. Product Photos

Unless the customer specifically requests otherwise in writing before production begins, we may photograph completed products and use these images for:

• our website;
• social media;
• advertising;
• portfolios;
• marketing purposes.

We will never sell or transfer ownership of customer artwork.

17. Limitation of Liability

To the maximum extent permitted by law, CustomBierViltjes.nl shall not be liable for:

• indirect damages;
• lost profits;
• lost business;
• lost revenue;
• consequential damages;
• delays beyond our control.

Our total liability shall never exceed the amount paid by the customer for the relevant order.

18. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

• natural disasters;
• fire;
• war;
• pandemics;
• power outages;
• supplier failures;
• strikes;
• transportation disruptions;
• government restrictions.

19. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

20. Changes to These Terms

We may update these Terms at any time.

The version published on our website at the time an order is placed will apply to that order.

21. Governing Law

These Terms are governed by the laws of the Netherlands.

Any disputes shall be submitted to the competent Dutch court, unless mandatory consumer protection laws require otherwise.
